CO Constitution Requires Tax-Funded Schools Three Months Per Year

The Colorado Supreme Court is totally out of control. As Clear the Bench details, the court’s latest outrage is to allow a legal suit to force taxpayers to send more of their hard-earned money to government schools.
As Vincent Carroll summarizes, the suit would “undermine democracy and the separation of powers in Colorado.”
The Denver Post’s Tim Hoover nicely reviews the case. He writes, “Kathy Gebhardt, an attorney for the plaintiffs in the school-funding suit, said… courts would have to determine whether the right to a ‘thorough and uniform’ education funding system outweighs the right of citizens to vote on taxes.”
But why should the courts get to establish what constitutes a “thorough and uniform” education? As Carroll and others note, the state’s Constitution explicitly grants funding authority to the general assembly.
However, there is another telling line in the same provision that indicates what the document’s authors thought consistent with a “thorough and uniform” education: the line requiring schools “at least three months in each year.” Obviously, dramatically less tax spending on education is consistent with this part of the Constitution.
Here is the entire bit from Article IX:
Section 2. Establishment and maintenance of public schools.
The general assembly shall, as soon as practicable, provide for the establishment and maintenance of a thorough and uniform system of free public schools throughout the state, wherein all residents of the state, between the ages of six and twenty-one years, may be educated gratuitously. One or more public schools shall be maintained in each school district within the state, at least three months in each year; any school district failing to have such school shall not be entitled to receive any portion of the school fund for that year.

Lord Christopher Monckton, who was a senior advisor to Margaret Thatcher, was interviewed on Glenn Beck’s radio show on Monday. During the discussion, which was both serious and humorous, Monckton explained just how much free nations, but especially the US, have to fear from the treaty which will be proposed in Copenhagen at a “climate change” summit.
This is 16-minutes of must-hear radio if you want to understand just what is at stake as the anti-capitalist, pro-world-government would-be dictators truly try to take over the world after last year taking over our White House.
The Draft Treaty which Monckton discusses can be seen HERE and at the end of this note. Although the entire document is extremely alarming, the paragraphs which Monckton refers to are on page 18.

Is Charlie Crist really running as a fiscal conservative???

Over at his campagin web site, Florida governor and candidate for U.S. Senate, Charlie Crist, has the audio of a radio commercial (which you can hear by pressing the play button just below) in which he positions himself as a fiscal conservative. He has the gall to say “‘Enough is enough.’ That’s my message to President Obama. We can’t spend our way into prosperity or tax ourselves into growth…I said more government isnt’ the answer.”
I almost laughed out loud when I heard the ad. Crist is the guy who was the Republican poster boy for supporting Obama’s so-called “stimulus” package.
Crist goes on to note a Cato Institute ranking of governors, giving him the highest grade in the country in 2008. But that was before Crist’s support of the “stimulus”. Also, although I am a big fan of Cato, THIS article by Larry Hunter explains how Cato’s analysis misses some important points which, if included, would almost certainly have caused Crist to get a much lower grade. (Oh, by the way, Charlie, Cato is libertarian, not conservative.)
I understand politicians will say anything, but I can’t believe the cojones of Charlie Crist to market himself as a solid fiscal conservative. He probably has to have plastic surgery on his nose each time the radio ad runs.
Crist also believes the Algore hoax of man-made global warming and supports economically devastating “solutions” to the non-problem.
I have contributed to, and continue to support, Crist’s real Republican opponent, Marco Rubio, and I encourage you to do so as well. I know it’s hard to convine people to contribute to politicians outside their own states, but sometimes a race is important enough that the message needs to be sent. The Florida Senate contest (much like the special election in New York state where people should suppport the Conservative Party candidate over the Republican or Democrat, and I was pleased to see Dick Armey do just that) is one such race.
To avoid Countrywide vote, Democrats sneak out, change locks

Republican Darrell Issa (R-CA) was ready to force the House Committee on Oversight and Government Reform to vote on whether to subpoena records of Countrywide Mortgage’s “Friends of Angelo” program and other such Countrywide programs which might show favorable treatment being given to politicians (of both parties).
The Democrats, led by committee Chairman Edolphus Towns (D-NY) have been avoiding such a vote, maybe not least because Rep. Towns is already known to have received two mortgages from Countrywide. One courageous Democrat, Mike Quigley, a freshman from Illinois, has stated publicly that he supports the subpoena and the efforts to get the documents – which Bank of America (who bought Countrywide) have already said are ready to go once the subpoena is delivered.
Last Thursday, the Republicans showed up for a scheduled Committee meeting only to find that the Democrats were absent. The Democrats claimed they had a scheduling problem, with a conflict because of another committee’s mark-up of a bill which required the presence of several OGR Committee members. However, a Republican OGR staffer got video of the Democrats sneaking out of a side door from their supposed other meeting.
It’s clear that the Democrats are literally running away from a vote on the Countrywide subpoenas. And here’s the proof:
So what was Chairman Towns’ reaction to having his cowardice made public?
He had the locks on the Committee room doors changed so that Republicans could not use the room, telling Issa (the ranking Republican on the Committee) that Democrats would keep all the keys to the new locks.
Yes, this is what Democrat-run government has come to: literally locking Republicans out of meeting rooms.
Every Democrat on the Committee (with the possible exception of Quigley) should be ashamed, and Chairman Towns should be reprimanded (but he won’t be.)
Rep. Issa said that it’s almost certain that today’s meeting will be canceled because of the Democrats’ fear of a vote on the Countrywide subpoena issue.

Color me unsurprised. This from an administration who already got caught having meetings with government funded artists asking them to push the president’s agenda. This administration is starting to look more Chavez like every week.
Senate Finance ranking member Chuck Grassley (R-Iowa) is raising concerns that a Department of Health and Human Services Web site that urges visitors to send an e-mail to President Barack Obama praising his health care reform plan may violate rules against government-funded propaganda.
The Web page is accessed through a “state your support” button featured prominently on the HHS Web site and carries a disclaimer that the Web site is maintained by HHS.
