Ed Perlmutter Says Our Health Care System is Unconstitutional

Yep, I heard a new line in the health care debate today while out at the Obama care rally that passed through Denver today at North High School.
It’s little wonder we’ve lost touch with the Constitutionality of taking property and liberty away from citizens using the force of government to subsidize other individuals.
Representative Ed Perlmutter (D – CO District 7) actually had the gall to stand on stage at pro-Obama care and public option rally and make the charge that our current health care system is unconstitutional. Huh? That perked up my ears, did I hear him say what I thought I heard?
He continued on, asking the audience, with their ocean of pre-printed Health Care Now signs, if they’d heard of the 14th Amendment. Hmmm, I wasn’t sure where he was going with this but surely he wasn’t going to go THERE.
Yep, according to Ed Perlmutter, the 14th Amendment gives equal protection and people denied care and coverage don’t have equal access to health care so the existing system must be unconstitutional. I’m not sure if he was also going to expand that to include housing, food, and clothing. On that note, this guy down the street got a bigger loan for a BMW so I should also get one since the Constitution guarantees equal protection.
The 14th Amendment and Equal Protection
OK, here’s some text from Section 1 of the 14th Amendment:
“…No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.” [emphasis mine]Did you get that? Yes, the Constitution specifically refers to equal protection of law not to goods and services on the market. Seriously, a congressman in the United States House of Representatives made the public charge that our health care system violates the 14 Amendment.
Why Is Ed Perlmutter Misleading You?
He’s not a dummy, Perlmutter was a director of the law firm of Berenbaum Weinshienk before being elected to office and was also on the Board of Governors of the Colorado Bar Association. He’s purposefully engaged in intellectual dishonesty to rile up a bunch of unknowledgeable plunderers to make them not only not question the Constitutionality of what they’re advocating, but making them feel legally justified.

Please, citizens of Colorado Congressional District 7, you’ve now seen the true colors of Ed Perlmutter and how he’s fine lying to you (no, this can’t be an innocent mishap). Make sure to teach him a lesson about the Constitution and don’t let him continue serving you and carrying out his oath to “protect and defend the Constitution” for which he has no regard.

Actually, Ed’s right – ANY Federal government involvement in providing healthcare IS unconstitutional!
Who’da thunk it: Ed Perlmutter a convert to the enumerated powers constitutional restriction on government activity?

Ah yes, the Constitutional argument. Peripatetic Pundit – you are exactly correct. We can also say that Obamacare goes directly against the 10th Amendment of the Consitution. And quite frankly, there are numerous states that are enacting laws that will allow the citizens of those states to opt out of Obamacare, if it does pass. In fact Arizona will have that measure on it’s ballot for the mid-term elections. There are many of out here that are not just slightly informed about the Constitution, and can go around and around with him all day on the legality of a whole lot of programs that the federal government has incorrectly inacted, according to the Constitution. The federal government has overstepped it’s reaches in many ways, and has gone directly against what our Founding Fathers had in mind when the Constitution was enacted. And we must not forget, Obama stated more than a few times that the Founding Fathers incorrectly set up the Constitution to LIMIT government, and that it is a “negative” document, in that it does not let the federal government DO things. Well, we sure are seeing him try to make sweeping changes in that area!

He knows he can get away with lying about it, since his \"healthcare is a right\" audience won\’t be motivated, intellectually honest, or just plain smart enough to call him on it.
